Real Estate Auction Terms:

1.)  Highest Bidder  |  The highest and best bidder shall be the Buyer. The Seller, however, reserves the right to reject any and all bids and to adjourn the sale to a subsequent date. The Auctioneer has the sole discretion of setting bidding increments. If any disputes arise to any bid, the Auctioneer reserves the right to cause the personal property to be immediately put up for sale again.

2.) Taxes  |  All taxes shall be pro-rated between the Buyer and Seller to the date of settlement on a fiscal year basis. All taxes for prior years have or will be paid by the Seller.

3.) Transfer Taxes  | Seller shall pay 1/2 of the realty transfer tax and Buyer shall pay 1/2 of the realty transfer tax if applicable, provided, however, that the Buyer shall be responsible for any additional transfer taxes imposed if applicable.

4.) Terms  |  Upon closure of the auction, $1,000 will be charged to the winning bidder's on-file credit card. An additional $14,000 deposit in the form of certified check, personal check or wire transfer with fees paid for by Buyer due within 24 hours of the close of the auction, and the balance, without interest, on or before September 19, 2025 when bill of sale will be delivered and actual possession will be given to Buyer. The Buyer shall also sign a purchase agreement and comply with these terms of sale. Buyers Premium of 10% plus the bid price shall establish purchase price. 

5.) Forfeiture  |  The obligation of Buyer under this Agreement of Sale shall not be excused, limited, altered by or conditioned upon Buyer obtaining mortgage financing. Should Buyer fail to make settlement, as herein provided, the sum or sums paid on account of the purchase price, at the option of the Seller, may be retained by the Seller, either on account of the purchase price, the resale price or as liquidated damages. In the latter case, the contract shall become null and void. In the latter event, all monies paid on account shall be divided equally between the Seller and the Auctioneer, but in no event shall the sum paid to the Auctioneer be in excess of the rate of commission due to him.

6.) Marketable Title  |  A good and marketable title will be given free and clear of all liens and encumbrances. 

7.) Risk of Loss  |  Seller shall maintain the property grounds, fixtures and any personal property specifically sold with the property in its present condition, normal wear and tear excepted. Seller shall bear the risk of loss for fire or other casualties until the time of settlement. In the event of damage by fire or other casualty to any property included in this sale that is not repaired or replaced prior to settlement, Buyer shall have the option of rescinding this agreement and promptly receiving all monies paid on account of the purchase price or of accepting the property in its then condition, together with the proceeds of any insurance obtainable by Seller. Buyer is hereby notified that Buyer may insure Buyer’s equitable interest in the property as of the time of execution of this agreement.

8.) Warranty  |  Buyer acknowledges that he has INSPECTED THE PREMISES, The Seller’s Property Disclosure Statement and enters into this agreement to purchase as a result of said inspections and not as a result of any advertising or announcement made by the seller and/or the auction company or their selling agents. The property is being sold “AS IS” condition. 

a. Radon | Seller has no knowledge concerning the presence or absence of radon. The Seller makes no representation or warranty with regard to radon or the levels thereof.

b. Home Inspection | Buyer has inspected the property. Buyer understands the importance of getting an independent home inspection and has thought about this before bidding upon the property and signing this agreement.

c. Fixtures and Personal Property | Included in the sale and purchase price are all existing items permanently attached to the personal property, including but not limited to plumbing, heating, lighting fixtures (including, if present upon the property, chandeliers and ceiling fans; water treatment systems; pool and spa equipment; garage door openers and transmitters; television antennas; wall to wall carpeting; window covering hardware, shades, blinds; built-in air conditioners; built-in appliances; and the range/oven unless otherwise stated). No warranty is given to Buyer as to the working/functional condition of fixtures and/or personal property. All personal property will be removed at Seller’s discretion, if items are not removed they become the responsibility of the Buyer.

d. Ventilation/Mold | The Seller makes no representations or warranties with regard to mold or the absence of mold, adequate or inadequate air exchange or ventilation, or any other matters of home construction wherein mold may be present in the personal property.

e. “AS IS” | The personal property is being sold “AS IS” at the time of sale and at the time of the settlement. The Fiduciary/Seller herein makes no representations or warranties as to the condition of the mobile/manufactured home. The Purchaser accepts the property “AS IS”. The purchaser waives any claims for any liability imposed through any environmental actions. This agreement shall survive closing. A Seller’s disclosure has been made available to Buyer prior to the public auction and shall be exchanged by Buyer and Seller upon the signing of this agreement. If the Seller is an estate, the personal representative(s) will not deliver a disclosure to Buyer inasmuch as they are not required by law.

9.) If any buildings on these premises were built prior to 1978, they may contain lead paint. This property may contain wet lands.

10.) Financing  |   Buyer is responsible for obtaining financing, if any, and this contract is in no way contingent upon the availability of financing. The Seller will not pay points, settlement costs, or otherwise render financial assistance to the Buyer in this regard.

11.) Dispute Over Handmonies  |  In the event of a dispute over entitlement of handmoney deposits, the agent holding the deposit may either retain the monies in escrow until the dispute is resolved or, if possible, pay the monies into the County Court to be held until the dispute is resolved. In the event of litigation for the return of deposit monies, the agent holding handmoney shall distribute the monies as directed by a final order of the court or a written agreement of the parties. Buyer and Seller agrees that, in the event any agent is joined in the litigation for the return of deposit monies, attorneys fees and costs of the agent will be paid by the party joining the agent.

12.) This agreement shall survive closing. 

13.) This agreement may be signed and transmitted by email.

14.) Buyer and Seller agrees that Brian Burke Auctions may collaborate on any aspect of this contract.  The scope of collaboration shall include but is not limited to the negotiation, advertising, execution, sharing of resources, sharing of fees, and performance of any aspect whatsoever of the contract.

 

Online Bidding Terms:

1) AUCTION SITE USER AGREEMENT - This is a legal agreement between you (the User or Bidder) and the Site Owner or Brian Burke Auctions. You must be at least 18 years old to bid. Brian Burke Auctions, at its sole discretion, may ban from further use any Bidder or Seller which Brian Burke Auctions believes to have in any way misrepresented itself or any item, failed to abide by the terms and conditions, or conducted any improper auction behavior as determined solely by Brian Burke Auctions. Any Seller who misrepresented their items and any Bidder who improperly fails to carry through with a purchase will be banned from any further use and may be subject to additional legal actions.

2) REGISTRATION - All Bidders are required to register for an account to bid at our online auction. Bidders must register online providing the necessary registration information such as name, address, phone numbers, driver's license, email address, credit card information and any other information requested for identification. The Bidder hereby acknowledges that he/she is of legal age and sound mind. By registering you are agreeing that you have read and fully understand the complete 'Terms and Conditions of Auction', and any additional terms and conditions announced or posted on the website, and agree to be bound thereby. Bidders, whether a new or returning Bidder, agree that if any of the information associated with their bidding account – including contact information and credit card information – changes at any time prior to, during, or after this sale, Bidders will notify the Auctioneer of the change by updating their Bidder profile. All registered Bidders take full responsibility for their Bidder ID. Bidder IDs are nontransferable. All bids made by the holder of the Bidder ID will be the responsibility of the registered Bidder. All sales are final. No refunds, reductions, returns or exchanges! The Auctioneers reserve the right to refuse any applicant for a bidding ID or the privilege of bidding at any online auction and to revoke such privilege at any time. PLEASE NOTE: After you have registered for an online auction, the Auctioneer will authorize the credit card you have placed on file for $500. This $500 deposit is not a charge, only an authorization hold; if you decide not to make any bids during this auction, or if none of your bids are successful, the Auctioneer will not take any monies from your account, and the authorization hold on your $500 will be lifted in accordance with the procedures of your credit card provider and/or banking institution. 

3) ALL ITEMS SELL WITH A RESERVE - All items in the online auction that sell with reserve and are subject to Brian Burke Auctions and/Sellers acceptance and/or rejection of the high bid.

4) BIDDING - Do not bid unless you agree to all of the terms and conditions posted herein. By bidding you are acknowledging agreement with all of the terms and conditions included herein and elsewhere on our website. The highest Bidder shall be the Buyer and no Bidder shall retract their bid. A Bidder is deemed to have accepted an item or lot when they make their bid. A successful bid at auction constitutes a legally binding contract of sale. All sales are final. The Auctioneers reserves the right to bid on behalf of the Seller(s). The Auctioneer reserve the right to reject any and all bids on items and lots not being sold at absolute auction. The acceptable bidding increments are established and controlled by the Auctioneer. 

5) GOOD CHOICE – Brian Burke Auctions wants everyone to have a good buying experience. However, when a bidder bids on a wrong item or decides an item is not suited for their intended use, our Sellers/Consigners will not assume the cost of the bidder’s mistake. Bidders agree that their failure to inspect or otherwise become fully informed about the items offered for sale at auction will not be grounds for a refusal to pay amounts due, nor for any claim against the Auctioneer. Bidders acknowledge and agree that they may not withdraw or retract any bid made that has been acknowledged by Auctioneer or that has been submitted online through their account.

6) ABSENTEE BIDS & PROCEDURE - All absentee bids are handled by the online auction system of bidding. The Bidder understands that all terms and conditions posted herein including addendums and attachments, apply to absentee bids as well. Because of the random nature of the auction bidding process, it is possible for the high bid to be by another Bidder, at the same amount that was left by the Absentee Bidder, therefore, it is agreed by the Absentee Bidder that neither the Sellers, Auctioneers, licensees, employees nor representatives, including the online auction service provider assume any liability or responsibility of any kind whatsoever for failure to execute bids for or on behalf of the Absentee Bidder for any reason whatsoever.

7) BUYERS PREMIUM - A Buyers Premium applies on all purchases unless otherwise stated. A Buyers Premium will be added to all purchases. A Buyers Premium is a predetermined percentage added to the high bid price to achieve the contract sales price. The use of a Buyers Premium will not in any manner whatsoever constitute an agency relationship between the Auctioneers (their licensees, employees or agents), and the Bidder. The Auctioneers, licensees, employees and agents are agents for the Seller Only. The Buyers Premium may vary depending on the auction. Brian Burke Auctions may change the Buyers Premium at any time to meet the needs of the Seller and/or to abide by the auction listing agreement. You may call our office to find out the exact amount of the Buyers Premium for any auction.

8) PURCHASE PRICE CALCULATION - Note that the purchase price is the sum of the bid price, the Buyers Premium, any Buyers Fee, and the sales tax if applicable. All payments must be in US dollars. Brian Burke Auctions reserves the right to charge the total amount or any remaining balance of your purchase price on your credit card if the balance is not otherwise paid. We do not accept partial payments. Invoices must be paid in full prior to pick up.

9) SALES TAX (if applicable) - All applicable sales tax, according to the governing tax laws in the state where the auction is being held, will be added to the purchase price on all taxable items or lots unless the Bidder uploads a properly completed tax exempt form to their bidding profile prior to the auction. All Buyers will be subject to the sales tax unless they provide the necessary documentation we require for exemption status (out-of-state Buyers and out-of-country Buyers must pay sales tax on all items including titled items), unless stated otherwise in the auction terms.

10) PHOTOGRAPHS AND DESCRIPTIONS – Online auctions contain item descriptions and photographs to aid Bidders in the bidding process and will make every effort to ensure the descriptions and photographs which are posted accurately represent the items being offered for sale.  In some photographs, multiple items may appear to be joined as a single unit, however, bidders should not assume a lot consists of more than one item simply because various items appear connected or are featured in the same photograph.  It is also understood that on occasion, the wrong photograph may be displayed for a given item.  No item or lot shall be sold or deemed to be sold by description or photo alone.  Preview of lots are suggested.

11) ADDITIONS OR WITHDRAWALS - The Auctioneers reserve the right before, or during the auction, to (a) withdraw from the auction any of the items or lots listed, (b) to sell at this auction items or lots not previously listed (c) to group and regroup items and lots, or separate items and lots, or parts of a lot as deemed necessary, (c) to make changes to the auction’s closing, inspection or removal times (d) to add minimum bids or reserve prices, (e) to sell all of the items and lots listed in bulk or to sell any and all items or lots prior to the auction. (f) reopen the bidding in its sole and absolute discretion or (h) take any other action the Auctioneer deems necessary to affect the fair conduct of the sale or protection of bidders’, sellers’, or other parties’ interests. All items and lots are subject to prior sale and cancellation. Auctioneer and Seller reserve the right to augment the auction with items from additional Sellers. These items and lots may be interspersed and not specifically identified throughout the auction.

12) AS IS - WHERE IS - All items and lots are sold on an 'AS-IS', 'WHERE IS' and 'WITH ALL FAULTS' basis 'WITHOUT EXCEPTION' with no warranty of any type expressed or implied as to the merchantability or fitness for any particular purpose of any goods offered in this sale. The Auctioneer and Seller expressly and specifically disclaim, without limitation, any warranty of merchantability or fitness for a particular purpose. Removal is at the Buyer's sole obligation, risk, and expense. No sale will be invalidated by reason of any defect or inaccuracy in any of the items or lots by reason of their being incorrectly described orally or written, invoiced, or cataloged, and no liability will be borne by the Auctioneers, licensees, employees and agents in respect to any such faults or errors. All marketing and information has been prepared only as a guide and is not offered as completely accurate, nor does it give the Bidders all of the information on the item or lot. Except as herein contained, there shall be no guarantees or warranties, expressed or implied, statutory, or otherwise of any nature whatsoever. The Buyers will accept the items or lots despite any defects or conditions, known or unknown, visible, or not visible, and therefore Buyers do by these presents remise, release, acquit, quit claim and forever discharge the Sellers, Auctioneers, licensees, employees and agents from any and all claims now and in the future. The Bidders should avail themselves the opportunity to inspect all items and lots. All Bidders are urged to physically inspect the item(s) during the inspection period. All sales are final. No bids can be withdrawn during or after the auction for any reason. Bidders understand that these terms as well as all other terms and conditions can only be amended or revised in writing and signed by the Auctioneer. Bidders also agree that any oral, written, or electronic representation made by the Auctioneer shall not modify these "AS IS - WHERE IS" terms. Bidder understands that any description given in the catalog or written on the equipment is not guaranteed, and Bidder will rely entirely on their own inspection and/or investigations. All information and descriptions contained in advertising this sale is believed correct, but no responsibility is assumed by Brian Burke Auctions or Seller for any errors or omissions.

13) VIEWING - The Bidders are afforded a time specific stated opportunity (or viewing by appointment) to inspect the items and lots prior to final close of the online bidding for the auction unless stated otherwise. The Bidders are relying solely on their investigations and inspections, and not any representations made by the Sellers, Auctioneers, their licensees, employees and agents or descriptions posted online. The Auctioneer strongly encourages Bidders to attend the scheduled inspection when held.  If an inspection is scheduled and Bidders choose not to attend the scheduled inspection or are in doubt about the condition, completeness, or suitability of a given item, they should please bid accordingly. The Bidders hereby waive any and all further inspections. The Bidders fully agree and understand that they are purchasing each and every item and lot in an 'As-Is'-'Where-Is' condition, with all its goodness and faults. The Sellers, Auctioneers, their licensees, employees, and agents, make no representations, guarantees or warranties of any kind, either expressed or implied, statutory or otherwise of any nature whatsoever.

14) AUTO EXTEND FEATURE - Please note when bidding, there is an auto-extend feature on this online auction system. If someone bids in the last 1 minute immediately prior to the end of the auction on that item, the online auction system will automatically extend the bidding time for a 90-second increment (and will continue to do so) until that period (after the original closing time) where no one bids, then the auction on that item will close. This feature will leave the bidding open for any item that has received a bid within the last minute from the last recorded bid time, even if the ending time has been reached. This feature has been added to eliminate last second bidding and to make the online bidding process fairer and resemble a 'live' auction. Keep in mind that seconds are not recorded with bid entries. A bid recorded at 5:30 and 40 seconds will have a recorded bid time of 5:30. Bid and refresh immediately and often.

15) POSTED CLOSING TIMES - Posted closing times and displays of the Auction Companies current time are approximate. Brian Burke Auctions reserves the right to close early or extend an auction at any time at its sole discretion. Closing times are staggered with varying number of items closing per minute (number varies per auction). It is strongly recommended to use the max bid feature or to bid early to avoid losing out due to an ill-timed, last-minute bid or technical difficulty. All times are based on the Eastern Standard Time Zone unless stated otherwise.

16) PAYMENT RESPONSIBILITY - The Bidder hereby further agrees that whether he/she shall be acting as a principal, an agent, an officer or director of a corporation or partnership, or otherwise in any capacity whatsoever, the Bidder and the Company he/she represents shall both be responsible for the payment of the purchase price, Buyers Premium.

17) FORUM SELECTION AND APPLICABLE LAW - The parties agree that any litigation or dispute concerning enforcement of this contract or arising out of this online auction shall be brought in the State of Pennsylvania, the jurisdiction shall be in the County of Wyoming and that Pennsylvania law shall govern, irrespective of the location, county or state where the auction was held. The prevailing party shall be entitled to an award of court costs and attorney fees incurred.

18) WARRANTY - This site and the information, content, and materials on this site are provided on an 'AS IS' 'Where Is,' and 'Where Available' basis. Auctioneer/Provider makes no representations or warranties of any kind, expressed or implied, as to the operation of the site, the content, information, or the materials on this site. To the fullest extent permissible under applicable law, provider expressly disclaims all warranties, expressed or implied of any kind, with respect to any of the materials, content, or information on this site or any goods or other products or services offered, sold, or displayed on this site or your use of this site generally, including warranties of merchantability, accuracy of information, quality, title, fitness for a particular purpose, and non-infringement.

19) INFORMATION DESCREPENCIES - While quantities and descriptions are believed to be correct, there are no warranties or guarantees, expressed or implied, and the Auctioneers, licensees, employees and agents will not be held responsible for advertising discrepancies, inaccuracies or failure of the merchandise to correspond with any standard and/or expectation. No item or lot shall be sold or deemed to be sold by description or photo along. Preview of lots are suggested. A Bidder shall not be entitled to rely on any representations made either in writing or orally, by or on behalf of, the Sellers, Auctioneers, licensees, employees, and agents. The description, measurements, dimensions, serial and machine numbers, year, model, quantities, weights, value, quality, capability, usability, function, performance, condition, salability or other particulars set out in the newspaper ads, auction brochures, catalogs, and/or invoices are believed to be accurate, but such information is given by way of identification only and no warranty, condition or guarantee is given or is to be implied as to the accuracy of such descriptions, measurements, dimensions, serial and machine numbers, year, model, quantities, weights, value, quality, capability, usability, function, performance, condition, salability or other particulars, or the genuineness or authenticity of any item or lot, and neither Sellers nor Auctioneers, licensees, employees and agents, will be responsible for any damage or loss, consequential or otherwise, arising as a result of any inaccuracy in respect thereof. Announcements and postings shall take precedence over any advertising or pre-auction material, written, oral and/or electronic.

20) DISCLAIMER OF WARRANTY AND RELEASE - Bidder expressly agrees that the use of this Website is at their sole risk, responsibility, and obligation. Neither Brian Burke Auctions, its affiliates, nor any of their officers, directors, licensees, employees, agents, third-party content providers, or licensors (collectively, 'Providers'), or the like, warrant that this Site will be uninterrupted or error-free; nor do they make any warranty as to the results that may be obtained from the use of this site, or as to the accuracy, completeness, reliability, security, or currency of the Site.

21) ERRORS, OMMISSIONS, ETC - The Site may contain errors, omissions, inaccuracies, or outdated information. Further, Auctioneer/Provider does not warrant reliability of any statement or other information displayed or distributed through the Site. Auctioneer/Provider reserves the right, in its sole discretion, to correct any errors or omissions in any portion of the Site. Auctioneer/Provider may make any other changes to this Site at any time without notice. Auctioneer/Provider makes reasonable commercial efforts to make the Site available at all times, however, Auctioneer/Provider is not responsible for any service interruptions, including, but not limited to, interruptions that may affect aspects of the sale of items.

22) INDEMNITY CLAUSE - Bidder(s) agree to indemnify and save harmless Auctioneers and their employees, licensees, agents, successors or assigns, against any and all claims, injury, loss, liabilities, lawsuits, damages, demands, action or cause of action whatsoever in any manner arising from this auction or privately negotiated sale; including costs, expenses, or compensation whatsoever, direct or indirect, known or unknown, foreseen or unforeseen, which the Bidder now has or which may arise in the future on the account of or in any way growing out of or connected with any defects, latent or otherwise, or the physical condition of any items or lots purchased or any law or regulation applicable thereto. The indemnity clause applies to the auction and/or a privately negotiated sale, before, during and after, the auction or the privately negotiated sale, and shall survive settlement or lack thereof. Auctioneers are not responsible for accidents. Buyers must insure their own liabilities, interests, etcetera in all real estate and/or personal property. The Buyer(s) also agree to indemnify and save harmless Auctioneers and their employees, licensees, agents, successors or assigns, against any and all claims, injury, loss, liabilities, lawsuits, damages, demands, action or cause of action whatsoever in any manner, etcetera, pertaining to hazardous materials, substances, sites and/or conditions, (known or unknown), and are strictly and solely the Seller's ownership, responsibility and liability.

23) LIMITATION OF LIABILITIES - You agree that the Auctioneer/Provider and its providers shall not be liable for any damage, loss, or expense of any kind arising out of or resulting from your possession or use of the materials, content, or information on this site (Auctioneers or Provider) or from your purchase or sale of goods through this site regardless of whether such liability is based in tort, contract, or otherwise. In no event, including without limitation, a negligent act, shall Auctioneer/Provider or any of its providers be liable to you for any direct, indirect, special, incidental, consequential, or punitive damages (including, without limitation, loss of profits, loss or corruption of data, loss of goodwill, work stoppage, computer failure or malfunction, or interruption of business, etc.), arising out of or in any way related to the materials, content, or information on this site or any other products, services, or information offered, sold, or displayed on this site, your use of, or inability to use this site generally, or otherwise in connection with this agreement, regardless of whether Auctioneer/Provider or any of its providers have been advised of the possibility of such damages.

24) RECORDS - The records (written, audio, video, digital, computer generated and etc.) of the auction kept by the Auctioneers, Providers, bookkeepers and employees will be taken as final in the event of any disputes or claims.

25) AGENCY - The Auctioneers, licensees, employees, and agents are acting as an agent for the Seller only and are not responsible for acts of its principals, nor liability for damages, accidents, or theft.

26) BINDING - It is agreed that the Bidder shall be bound by these terms and conditions, and if there is more than one Bidder, the obligations imposed by these terms and conditions, shall be joint and several. If any term or condition is determined by a court to be unenforceable, the remainder of the terms and conditions shall not be affected. All terms and conditions shall survive settlement or lack thereof.

27) Bidder agrees that Brian Burke Auctions may collaborate on any aspect of this contract.  The scope of collaboration shall include but is not limited to the negotiation, advertising, execution, sharing of resources, sharing of fees, and performance of any aspect whatsoever of the contract.

FIREARM Terms and Conditions:

 

1. You must be 18 years old or older to register for this auction. You must be 18 years old to purchase a long gun and 21 years old to purchase a handgun. 

 

2. Brian Burke Auctions/Burke's Gun Shop LLC has not fired any firearm in this auction. As such we cannot and do not warranty these items. You should have all guns inspected for safety prior to using them. NO REFUNDS.

 

3.      All property is sold AS IS with all faults and blemishes, and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidders responsibility to determine condition, age, genuineness, value or any other determinative factor. Brian Burke Auctions and/or Burke's Gun Shop LLC may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall Brian Burke Auctions and/or Burke's Gun Shop LLC be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value.

 

4. Brian Burke Auctions is providing Internet pre-auction and live bidding as a service to Bidders. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Brian Burke Auctions or anyone else if the Internet service fails to work correctly before or during the live auction. Brian Burke Auctions will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Brian Burke Auctions reserves the right to withdraw or re-catalog items in this auction.

 

5. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. Brian Burke Auctions/Burke's Gun Shop LLC endeavors to describe each item. Brian Burke Auctions/Burke's Gun Shop LLC will not be responsible for errors in descriptions. Brian Burke Auctions/Burke's Gun Shop LLC will not guarantee grades or authenticity on coins. All grading questions should be addressed prior to sale time. We will be happy to email other pictures to you, if needed. All sales final. 

 

6. All Federal and State firearms laws will be complied with. Background checks will be conducted on ALL firearm purchases. Firearms must be paid for before a background check. Failure to pass the background check will result in the buyer consigning the item to an upcoming Auction. Any out of state firearm purchases must be shipped to an FFL dealer in your area. The buyer is responsible for actual shipping plus a $15 handling fee per firearm. This will be determined by the shipper. Some firearms may not be legal in all locations. Know your local laws before you bid. NO REFUNDS.

 

7. No international shipping.

 

8. You will need to have a copy of your local FFL dealers license emailed to our office within 48 hours of a winning bid. You must include: your name, phone number and bidder number. 9. All pickups and local payment must be handled during the designated pickup period.  Background checks will be completed at that time. 

 

10.  Firearm dealers holding an FFL must provide a signed and up to date copy of a Federal Firearms License.  No background checks are required for FFL holders.  In addition, a sales tax exemption form can be provided to mark your invoice as tax exempt.  Please email a copy of the FFL and Tax Exemption form to info@brianburkeauctions.com

 On-line Bidding Terms:

 

1.     Brian Burke Auctions/Burke's Gun Shop LLC has put forth every effort in preparing the catalog for this auction to provide accurate descriptions of all items. All property is sold “AS IS, WHERE IS” and it is the bidder’s responsibility to determine the exact condition of each item. Printed statements or descriptions by staff are provided in good faith and are matters of opinion. Absolutely NO refunds will be offered.

 

2. There is a 15% Buyer's Premium added to your total purchase. PA State Sales Tax. (With Shipping or Local Pickup)

 

3.     Bidders are approved for online bidding based on their previous records and information provided by HiBid. Credit card payment information must be entered before approval. Approval is solely at the discretion of Brian Burke Auctions. We are not aware of any online bids in advance, but only during the time of the auction as they are forwarded to our computer. Brian Burke Auctions will not be responsible for any omissions, errors or slow communications related to online bidding. In the event of a tie bid between a floor bidder and an online bidder, the floor bidder will take precedence. The auctioneer has the decision in this matter is final.

 

4.    All accounts must be settled at the conclusion of the auction. We accept Visa & MasterCard ONLY. NO CHECKS FROM ONLINE BIDDERS!  All credit card charges will come from Burke's Gun Shop. 

 

5.     The auction company through UPS/FedEx/USPS and will arrange packing/handling and shipping. Packing and shipping costs are the responsibility of the buyer. All items will be insured for the purchase price. Our first priority is to deliver your purchase in excellent condition. We charge actual shipping plus a $15 fee per box for handling. (See Firearms Terms)

 

6.     Our on-line auctions move quickly! If you are interested in an item, bid quickly. If you win an item in the auction, you will be notified by email the next business day. All items will be charged to the credit card on file. Any bidders with credit cards that are declined on reconciliation day will be charged a $35 processing fee to run another credit card- NO EXCEPTIONS!

 

7.     In order to better serve our customers, all bidders must provide their name, address, daytime phone number, and email address at which they can be contacted. This is to insure good communication between Brian Burke Auctions/Burke's Gun Shop LLC and the bidder throughout any transactions.

 

8.     The purchaser agrees to pay all reasonable attorney fees and costs incurred by the auction company in the collection of funds. The purchaser also agrees that a fee of 2% per month will be added to the balance of any unpaid balance due the auction company and any other costs or losses incurred by the purchaser's failure to adhere to these terms. Any and all disputes that arise under terms of this contract are to be submitted to arbitration in the county of our residence. Wyoming County, Pennsylvania.

 

9.    The auctioneer has the sole discretion to advance the bidding and may reject a nominal advance, should it in his estimation prove injurious to the auction. The auctioneer shall be the final judge in all bidding disputes and shall name a bidder as the purchaser.

 

10.  The auction company shall not be held responsible for any 'missed' bids or bids unseen by the auctioneer. The auctioneer reserves the right to reopen a tied bid between the tied bidders and no one else.

 

11.   All sales are final.

 

12.   By bidding on any item, the bidder shows acceptance of the terms of the auction.

 

13.  The auction company reserves the right to refuse service or decline registration to any person.
